We have been receiving many questions about the conditions for the use of so-called cookies this year. Therefore we would like to make you aware that the Czech Republic has finally implemented into the text of the Electronic Communications Act similar rules for the use of cookies as they apply in neighbouring countries. As of 1 January 2022, Czech law also stipulates the obligation for anyone who intends to store data or access data stored on the end devices of subscribers via websites using cookies, to have the user’s prior demonstrable consent to store them. This consent must meet the general requirements of the European Data Protection Regulation (GDPR) for consent to the processing of personal data.

If you have already correctly and consistently implemented the data protection system in the area of cookies and websites in compliance with GDPR, you have already implemented almost everything you need for compliance with the new Czech law, since the new wording of the Electronic Communications Act mostly only confirms what we have so far derived from the wording of the  GDPR.
